When you request an estimate through our website or by phone, we will schedule an on-site visit to assess your project. Our estimates are provided free of charge and without obligation. An estimate is not a final contract - it is an approximation based on the information available at the time of the visit.
Final pricing is set only when you sign a written contract with us. If site conditions change, unknown issues are discovered during the work, or you request changes to the scope of the project, the final price may differ from the estimate. Any such changes will be discussed with you before the work proceeds.
All work is performed under a written contract signed by both parties. The contract will specify the scope of work, materials, project timeline, payment schedule, and any relevant terms or conditions. You are encouraged to read the contract carefully before signing. Once signed, both parties are legally bound to the terms of that contract.
If you wish to cancel or modify a contract after signing, California law may provide you with a limited right to cancel within a certain period for home improvement contracts over a specified dollar amount. Your contract will include any applicable cancellation rights and procedures. Changes to a signed contract must be documented in writing and agreed to by both parties.
Payment terms are defined in the service contract and typically include a deposit before work begins and one or more payments tied to project milestones or completion. All payments must be made on time according to the agreed schedule. We accept payment by check, cash, or other methods as specified in the contract.
Late payments may be subject to finance charges or collection action as permitted by California law. If you fail to make a payment, we may suspend or stop work until the account is brought current.
If you dispute any portion of an invoice, you must notify us in writing within 10 days of receiving the invoice so the matter can be resolved before the due date.
Every contract includes an estimated timeline for project completion. We make every effort to meet that timeline. However, project schedules may be affected by factors outside our control, including weather, permit delays, supplier issues, or unexpected site conditions. If a delay occurs, we will notify you and work with you to adjust the schedule.
If the delay is caused by the customer - for example, failure to provide access to the property or failure to make required payments - we are not responsible for the resulting impact on the schedule or cost.
For projects requiring a building permit, Downey Concrete will obtain the necessary permits on your behalf and coordinate all required inspections. Permit fees are the responsibility of the customer and are typically included in the contract price.
All work is performed in compliance with the California Building Code and local ordinances. If the building department requires corrections or modifications to the work, we will complete those at no additional cost as long as the changes are related to our work and are not the result of code changes or customer requests outside the original contract scope.
We stand behind our workmanship and materials. Unless otherwise specified in the contract, we provide a limited warranty covering defects in materials and workmanship for a period of one year from the date of project completion. This warranty does not cover damage caused by improper use, neglect, or acts of nature.
To make a warranty claim, contact us in writing at the email or phone number listed at the end of these Terms. We will inspect the issue and, if it is covered under warranty, repair or replace the defective work at no charge to you.
This warranty is in addition to any manufacturer warranties on materials used in the project. THE WARRANTY STATED ABOVE IS THE ONLY WARRANTY PROVIDED BY DOWNEY CONCRETE. WE DO NOT PROVIDE ANY OTHER EXPRESS OR IMPLIED WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
Downey Concrete is licensed and insured as required by California law. Our liability is limited by the terms of our insurance coverage and applicable law. In no event will Downey Concrete be liable for indirect, incidental, special, or consequential damages arising from the performance or delay of services, even if we have been advised of the possibility of such damages.
Our maximum liability for any claim related to the work performed under a contract will not exceed the total amount paid by the customer under that contract. This limitation does not apply to personal injury or property damage caused by our negligence or willful misconduct, which are covered by our liability insurance.
You agree to provide our crew with reasonable access to the work site during normal business hours or as agreed in the contract. You are responsible for moving personal property, vehicles, or other items from the work area before we begin. We are not responsible for damage to items left in the work area unless that damage is caused by our negligence.
If we encounter hazardous materials, underground utilities, or other unexpected conditions during the work, we will stop work in the affected area and notify you. Any additional work required to address those conditions will be performed only after mutual agreement on the scope and cost.

These Terms and any contract for services are governed by the laws of the State of California without regard to conflict of law principles. Any disputes related to these Terms or to services provided will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts.
If a dispute arises, we encourage you to contact us directly so we can attempt to resolve the matter informally. If that is not successful, either party may pursue mediation or arbitration before filing a lawsuit. California law provides contractors and customers with the option to participate in the Contractors State License Board's dispute resolution process for certain types of claims.
If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
We may update these Terms from time to time to reflect changes in our business practices or legal requirements. When we do, we will update the effective date at the top of this page. Your continued use of the website after changes are posted constitutes acceptance of the updated Terms. Any services performed under a signed contract are governed by the terms of that contract, not by changes to the Terms posted on the website.
